Suffolk County Motorcycle Accidents

You are 10 times more likely to die driving a motorcycle than if you are driving any other motor vehicle.

Motorcycle deaths increased for the 10th straight year. There were 5,154 motorcycle deaths last year, compared with 4,837 in 2006. (August, 2008)
- Ken Thomas, Associated Press Writer

Michael Gluck, one of our founding partners, has been riding sport bikes, cruisers and standards for more than 35 years. He has a clear understanding of motorcycle handling, the causes of accidents and the degree of injury motorcyclists experience.

Causes of Motorcycle Accidents

Researcher Harry Hurt conducted the most comprehensive study of the underlying causes of motorcycle accidents to date. Hurt established that an estimated 75 percent of all motorcycle accidents resulted from a collision with another motor vehicle, usually a passenger car. The major cause of motorcycle accidents stems from other drivers not seeing the motorcycle until it is impossible to avoid an accident or the collision has already taken place.

More motorcycle accidents occur at intersections than any other location, where trees, bushes, buildings and other vehicles obstruct the view of a motorcycle. Rain, sleet, snow, fog and other bad weather conditions also obscure visibility, making motorcycles difficult to detect and not leaving enough time for them to slow and avoid a crash.

The Personal Injury Attorneys at Rosenberg & Gluck, LLP, represent motorcycle riders injured by motorists in all accidents, including:

  • lane crowding or lane drifting
  • turning left in front of oncoming traffic
  • changing lanes without signaling
  • having a rear end collision
  • running a stop sign / stop light
  • pulling out of driveways on side streets
  • driving under the influence
  • falling asleep at the wheel

Other Factors Contributing to Motorcycle Accidents

Dangerous Road Conditions

While a very small percentage of motorcycle accidents occur because of unsafe roads, bikers can lose control when driving under poor road conditions, such as potholes, cracked or ridged pavement, uneven lanes, loose gravel, and other highway hazards. When a motorcyclist loses control, a motorcycle can go into a skid, fall and pin the biker between it and the ground. According the National Highway Traffic Safety Administration, an estimated 80 percent of motorcycle accidents cause serious injury or death.

Defects

As with other vehicles, motorcycles can have defective parts, such as defective tires, brakes or other features that cause accidents. Defective parts on the front end can cause wobbling at high speeds, making the motorcycle difficult to control. If vibrating caused by a defective part causes a motorcyclist to crash, the manufacturer could be held liable. Defective maintenance, such as a mechanic’s failure to align the wheels properly, can create a hazard for which the mechanic or shop would be responsible for the accident.

Establishing Liability

Motorists often claim they aren’t to blame when they’re involved in a motorcycle accident. At Rosenberg & Gluck, we understand the relationship between certain kinds of driver negligence and the damage done to a bike and the injuries a rider sustains. Working with accident reconstructionists, skid-mark analysts and other crash experts, our attorneys are effective in using the evidence from an accident scene to recreate what happened. We also talk to eyewitnesses and use computer animation and simulation to explain to jurors what a car or truck driver did wrong to cause the accident that injured our client or to expose third-party negligence, such as products liability or poor maintenance.

Recovering Costs for Injuries and Lost Earnings

Given the severity of most motorcycle accident injuries, it is important to accurately quantify the costs you face for future medical treatment, lost wages, and pain and suffering. To ensure you receive a fair settlement or award, our attorneys work with experienced medical professionals, life-care planners and economists who can provide a medical prognosis of your condition and the costs you will face as a result.

Because head trauma, back injuries, amputations and disfigurement are often involved in motorcycle accidents, providing expert witness testimony regarding the financial impact of your injuries is essential. We make sure jurors and insurance companies understand the issues and know why we will not settle for anything less than a fair offer.
