How a Lawyer from Rosenberg & Gluck, L.L.P. Can Help
At Rosenberg & Gluck, L.L.P., we understand motorcyclist collision cases. One of our founding partners, Michael Gluck, is an avid rider of sports bikes, standards, and cruisers. We understand the perspective of motorcyclists and can work to present the evidence from your side of the story in a personal injury claim.
Liability in a Motorcycle Collision
In some cases, motorcyclists are automatically blamed for the collision. However, a lawyer can work to demonstrate liability based on the evidence from your crash. If someone else’s negligence led to your collision and injuries, a lawyer can work to show that the other driver was liable.
We can work to show that the other driver was liable by using police reports, witness statements, or even any available camera footage of the crash. If necessary, we can work with collision reconstructionists and other experts who can assess what happened in your collision.
By demonstrating that the other driver was negligent, we will seek compensation for you through an insurance settlement or lawsuit, if necessary.
Managing the Process of Your Claim or Lawsuit
After we assess the details of your collision and gather evidence for your case, we will communicate with any insurance companies or liable parties on your behalf. This includes the process of negotiating a settlement offer. If there are any issues with seeking a fair settlement, your lawyer will handle the negotiations for you and recommend taking your case to trial if a fair settlement is not possible.
In New York State, there is a statute of limitations that sets guidelines for how long you have to file a claim after a collision. Generally, this window of time is three years after the day of the incident, according to New York Civil Practice Law & Rules (CVP) §214. There may be exceptions to this deadline, however. For example, if your case involves a municipality, or involves a wrongful death claim you have less time to file.
A lawyer will be able to tell you about any deadlines that may apply to your case.
We Understand Motorcycle Collisions
You do not have to be alone in the legal process after you have been hurt in a collision. At Rosenberg & Gluck, L.L.P., we understand motorcycle collision cases. We will be able to advise you on your legal options, and if we represent your case, we can manage all of the details for you.
You can take the time that you need to recover while we seek compensation on your behalf. Because we work based on contingency fees, you do not need to pay anything unless we secure compensation for you.
