How to Recover Compensation Under Lyft’s New Policy Agreement

The Driver’s Liability Insurance

This coverage is $100,000 per person and $300,000 per occurrence.  Outside of the city, there may be more coverage.

Lyft’s Liability Insurance

The DFS also states that rideshare companies in New York are required to carry $1.25 million in vehicle liability coverage for all parties that may be involved in a crash. However, this protection only applies in certain situations and does not apply when the app is off.

How Long do I Have to File My Claim?

Per CPLR § 214, if you intend to file a civil lawsuit against the Lyft driver, you generally have a three-year window to do so. However, in some situations, exceptions could shorten the deadline.

If the crash caused the loss of your loved one, surviving beneficiaries have two years to file a wrongful death lawsuit against the responsible party per EPT § 5-4.1.
